Dear Sir:
In the matter of the construction of the line of railroad of the Eastern
Oklahoma
Railway east from Guthrie, I wish to call your attention to the contract
of the Atchison Company with Messrs Guss and Coyle; our contract with them
is that the line shall be constructed and in operation from Guthrie east
to the crossing of the River by the first day of January. Based upon this
contract with us Messrs Guss and Coyle made contract with the people at
Perkins by which they agreed that the line of railroad should be constructed
and in operation from Guthrie to Perkins by the first day of January, and
hinging upon the construction of the line to Perkins at that time hangs
a cash subscription to Messrs Guss and Coyle of five thousand dollars.
Messrs Guss and Coyle have assumed a very large contract with us in
the
furnishing of this one hundred miles of right of way and I am rather of
the opinion that if by reason of our failure to comply with our contract,
at least to have the line constructed and in operation to Perkins by the
time named that they will have a valid offset against us in the sum of
five thousand dollars which they will lose from their subscriptions.
